Jim Powell Will Have To Wait A Little Longer...

...To learn whether he's the Democratic nominee for the Public Service Commission.

And as usual, Creative Loafing remains on top on Powell's fight to remain on the November General Election ballot after winning the July 15th Democratic Primary with more than 80% of the vote.

Creative Loafing Staff Writer Thomas Wheatley reports that Public Service Commission candidate Jim Powell says his appeal that was originally scheduled for today at 3 p.m. in Fulton County Superior Court has been postponed. Judge John Goger has recused himself because he’s a former law partner of Powell’s attorney. [Source: Creative Loafing, "Jim Powell’s PSC court case postponed", August 4, 2008]

Another lingering matter as it pertains to Jim Powell's appeal is whether he will be removed from the state Democratic committee should the Judge uphold the Secretary of State's decision to disqualify Powell as a PSC candidate.

The governing documents for the Democratic Party of Georgia says that the Democratic nominee for Public Service Commission is an ex-officio member of the state Democratic committee. If Jim Powell is thrown off the ballot, then does he retain his state committee seat?

I don't believe so.
